Terms of Service

These terms are the agreement between you and us when you create a Duskar account or play the game at duskar.com. By creating an account you accept them. Please read them together with our privacy policy, which explains how we handle your personal data.

Who we are

Duskar is run by Artur Rychcik Netshow.pl, a company registered in Poland (VAT number PL5711709563, REGON 361857749). You can reach us at [email protected].

The game

Duskar is a free browser game. You need a device with an up-to-date web browser and an internet connection; no download is required. The game is still being developed: we regularly add, change and rebalance its features, and some of them may be unavailable for a time while we work on them or maintain our servers.

Your account

  • You must be at least 13 years old to create an account. If you are not yet an adult where you live, a parent or guardian must agree to these terms on your behalf.
  • You may have more than one account, under the rules in “More than one account” below. Do not play someone else’s account.
  • Choose a display name that does not offend, mislead or impersonate anyone. We may change a name that breaks this rule.
  • Keep your password to yourself. You are responsible for what happens on your account, also when someone you gave your password to breaks these terms on it, so tell us at once if you think someone else has accessed it. If someone breaks into your account, we will do our best to repair the damage.
  • If you do not confirm your email address and do not play for 30 days, we may remove the unconfirmed account.

Fair play

Duskar is a multiplayer game, so it only works when everyone plays fair. You must not:

  • use bots, scripts, macros or any other tool that plays the game for you or automates it,
  • exploit bugs or errors in the game; report them to us instead,
  • make one account stronger at the expense of another (pushing), for example by selling yen, items or warriors to another player far below or above their market price, whether the accounts are yours or other people’s,
  • buy, sell or trade accounts, items, warriors or currencies for real money or anything outside the game,
  • attack, overload or try to break into the game, its servers or other players’ accounts.

More than one account

You may play more than one account, as long as each of them grows through its own play. Your accounts must never help one another:

  • they must not trade with each other in any way: no marketplace or exchange deals, no gifts or handovers of yen, items or warriors, however fair the price,
  • one of them must not help the other in fights, rankings, clans or planetoids, for example by losing arranged fights to it,
  • a second account must not help the accounts of your friends or your clan in these ways either.

The safest way is to keep your accounts completely apart. The marketplace does not let accounts on the same network trade with each other, and moderators can see the connections and transactions between accounts. If value moved between accounts, we may take it back from every account involved, and suspend them for large or repeated cases.

How you treat other players

Be respectful in the chat, in private messages, in clan texts, in your profile and in everything else other players can see. Do not harass, threaten or blackmail anyone, do not post hateful, sexual or violent content, spam or advertising, do not pretend to be a moderator or a member of the Duskar team, and do not share anyone’s personal data, your own included. Images you upload must be yours or used with permission and must follow the same rules.

What you create

What you write and upload stays yours. You allow us to store it, show it to other players and on public pages of duskar.com, and adapt it to the game’s format (for example by resizing an image) for as long as it remains in the game. We may remove content that breaks these terms.

Virtual items and currencies

Yen, star yen, gold yen, warriors, items and everything else in the game are part of the game. They have no value outside it, cannot be exchanged for money and do not belong to you as property: you receive a personal, non-transferable right to use them in the game under these terms. Warriors in Duskar age and die; that is how the game works, and the loss of a warrior is not a reason for a claim.

We may change, add or remove virtual items and currencies on an account when we fix an error, rebalance the game or apply a sanction. If an error in the game causes losses, we will try to restore the previous state or make up for it with other in-game items, but we cannot guarantee it.

Duskar does not accept real-money payments at the moment. Before it does, we will add the rules of purchases to these terms.

Invitations

You can invite friends with your invitation link and receive days of Elite premium when the players you invited reach certain account levels, starting at level 50. Rewards are for inviting real people who learned about Duskar from you. Do not create accounts with your own link, do not create accounts for each other with friends or clan mates, and do not spam your link in the chat or in messages. If we find that invited accounts belong to you or were created only to collect rewards, we may take the rewards back and apply the measures described below.

Moderation and sanctions

If you break these terms, we may, depending on how serious the breach is: warn you, mute you in the chat, block you from trading, take back what you gained by the breach, suspend your account for a time or close it permanently. Where we can, we tell you the reason. If you think a decision was wrong, write to us at [email protected] and we will review it.

Ending the agreement

You can stop playing at any time and delete your account yourself in the game’s settings. Deleting an account is permanent: your progress cannot be restored. We may end the agreement and close an account if its owner seriously or repeatedly breaks these terms, or if we shut the game down, in which case we will tell players in advance.

Complaints

If something in the game does not work as it should, write to us at [email protected], describing the problem and your display name. We answer complaints within 14 days.

Liability

We do our best to keep Duskar running and your progress safe, but we cannot promise that the game will always be available or free of errors. To the extent the law allows, we are not liable for losses caused by interruptions, errors or changes in the game. Nothing in these terms limits the rights you have as a consumer under the law of the country where you live.

Changes to these terms

We may update these terms, for example when the game gains new features or the law changes. We will tell you about important changes in the game or by email at least 14 days before they take effect. If you do not agree with the new terms, you can delete your account before then.

Law

These terms are governed by Polish law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you may bring a dispute before the courts of that country.
